Terms of Use
These terms apply to your use of upstridee.com (the "Site") and to the free offers on it, such as the sample trigger report and the first 10 leads. By using the Site, you agree to them. If you do not agree, please do not use the Site.
UpStride LLC ("UpStride", "we", "us") is a cold email lead generation company for B2B cybersecurity companies.

1. Who can use the Site
The Site is for business use by people who are at least 18 years old. If you use it on behalf of a company, you confirm that you have the authority to do so.
2. What the Site is, and what it is not
The Site describes our services. It is not an offer that you can accept by clicking a button. We provide paid services only under a written Service Agreement signed by both sides. If these terms conflict with a signed Service Agreement, the Service Agreement controls for the services it covers.
We do not promise any particular result, such as a number of replies, meetings or sales. Descriptions on the Site, including timelines such as "first meetings usually land in weeks 5 to 9", describe what we aim to do and what is typical. They are not guarantees. Our commitments are the process commitments written into the Service Agreement.
Nothing on the Site is legal, financial, tax or investment advice.
3. The free offers: sample trigger report and first 10 leads
When you submit a request through the Site:
- It is free and limited. We take a limited number of requests each week, build each one by hand, and may decline, delay, limit or stop offering them at any time. The response times on the Site are targets, not guarantees.
- It creates no obligation. Neither you nor we are committed to work together because of a request.
- It is provided "as is". A sample trigger report is based on public sources that we cite. We aim to verify each item, but we do not promise that it is complete, current or error-free, and you should check anything important before relying on it.
- Leads are yours to use, and the responsibility is yours too. We aim to verify the contacts we send, but we do not guarantee that every email address will be deliverable or every detail accurate. Once we deliver them, you may use them for your business. You are responsible for using them lawfully, including following the email, privacy and marketing rules that apply to you and to the people you contact, such as CAN-SPAM in the United States, CASL in Canada, and the UK and EU rules on marketing emails where they apply. You must honor opt-out requests.
- What you send us must be yours to send. Information you submit must be accurate and must not violate anyone else's rights.
4. Acceptable use
You agree not to:
- use the Site in any way that is unlawful, misleading or harmful;
- submit false information, impersonate anyone, or submit someone else's personal information without a right to do so;
- send spam, malware or automated submissions through our forms;
- scrape, copy or republish the Site's content at scale, or try to reverse engineer it;
- probe, scan or test the Site's security, or interfere with how it works.
We may block access or remove submissions that break these rules.
5. Our content and your content
The Site's text, design, graphics, logo, name and other content belong to UpStride LLC or its licensors and are protected by intellectual property laws. You may view the Site and share links to it. You may not copy, sell or reuse our content without our written permission.
If you send us feedback or suggestions, you allow us to use them without owing you anything.
You keep ownership of the information you submit to us. You give us permission to use it to respond to you, deliver what you requested, and run our business as described in our Privacy Policy.
6. Third-party sites and services
The Site links to and uses third-party services, such as Google Calendar for booking a call and LinkedIn. We do not control them and are not responsible for their content or practices. Your use of them is governed by their own terms and policies.
7. Disclaimers
The Site and everything on it, including the free offers, is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Site will be uninterrupted, secure or free of errors.
8. Limitation of liability
To the fullest extent the law allows, UpStride and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of the Site or the free offers. Our total liability for any claim relating to the Site or the free offers is limited to one hundred US dollars ($100).
Some places do not allow certain limits, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
9. Indemnity
You agree to defend and reimburse UpStride for claims, losses and reasonable costs that come from your breach of these terms, or from your unlawful use of the leads or reports we deliver to you.
10. Changes and ending access
We may change the Site, the free offers, or these terms at any time. The updated terms will be posted here with a new effective date, and using the Site after that means you accept them. We may suspend or end your access at any time if we believe you broke these terms.
11. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute about these terms or the Site will be brought in the state or federal courts located in Alameda County, California, and you and we consent to those courts' jurisdiction.
12. General
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term, that does not mean we have given it up. These terms, together with our Privacy Policy, are the whole agreement between you and us about the Site.
